Abstract
Mit der rasanten Entwicklung der Suchmaschinentechnologien sowie der wachsenden Marktkraft von einzelnen Suchmaschinenanbietern und deren steigender Bedeutung im Blick auf den Informationszugang verändert sich nicht nur die Anzahl, sondern auch die Qualität derjenigen Konflikte, welche die Gerichte, Gesetzgeber und Behörden in den USA und in Europa beschäftigen. Das vorliegende Kapitel zeichnet - basierend auf einer andernorts vorgelegten Detailanalyse - in groben Umrissen diese Geschichte der Entstehung eines >Rechts der Suchmaschinen< nach und diskutiert sodann ausführlicher, welche Debattenthemen in der sich entfaltenden Regulierungsdiskussion eine besonders prominente Rolle spielen und die eher punktuellen rechtlichen Interventionen aus der ersten Regulierungswelle abzulösen scheinen. Daran anschließend werden die zentralen Herausforderungen beleuchtet, welchen sich nationale Gesetzgeber bei ihren Regulierungsbemühungen gegenüber sehen. Im letzten Teil des Kapitels wird der Bedarf nach einer systematischen Evaluation von alternativen (und teilweise konkurrierenden) Ansätzen der Suchmaschinenregulierung illustriert und zum Schluss grundlegende Wertungen eines demokratisch strukturierten informationellen Ökosystems diskutiert, aus welchen normative Kriterien für die kritische Beurteilung von nunmehr in steigender Kadenz vorgelegten Vorschlägen zur >Suchmaschinen-Governance< abgeleitet werden können.
